It will not be easy as we love this country too...but then one of the main reasons we are going back is the way is the culture here... thanks a lot guyz for all ur replies. My only concern is can they claim the GC expenses(lawyer fee and advertisement costs involved in PERM filing) as the expenses they incurred because of me leaving the company if they file a law suit using non compete. There is no other expense relocation, training or another kind of expense that company has incurred for me(not a single penny except h1b filing). and one more thing i want to let u know is that i am workign with the same client just changed my h1b to PF. Will that be a trouble??? As i have already mentioned earlier in the agreement of company A with PF when i joined the company clearly specifies that PF can take me immediately upon my termination with company A.

This is my first post.
My Employer's Inhouse Attorney ( one of big 4 ) says technically EB dependents ( all 1,2,3) must be classified under FAMILY quota. USCIS mis classifies them under EMPLOYMENT quota.
Is he technically correct ?
Since, Most of dependents will not be affected when they are classified under Family quota (as they have AP and EAD).
Can IV possibly consider for push for reclassification of Dependents under Family Quota ? This will reduce backlog.
Please don't take it out of context, I am not trying to hurt any EB dependents, I too have a spouse working part time using beneficiary EAD. This is more of an open question.
Will you join our hands in recapture ? Will you considering contributing to IV. I will be happy if you can activlly participate in our effort.

BharatPremi, I hope your predictions are either met or excelled. I will pray for the happiness for your future 7 generation :-). After waiting for so many years, even 2009 does not sound that bad. I know I have no right to complain since many in EB3 have been waiting for years before me.
I also agree that porting to EB2 is not easy. A couple of my friends had their PERM labor itself rejected. I think waiting it out in EB3 may not turn out to be that bad. Or I do hope so....

If there's a recession (even with a soft landing) in 2007, as many economists and Wall Street people are saying, and we don't get SKIL Act through congress during lame-duck session -- what will it mean for us? Will business lobbies still have a strong case to sell to lawmakers amid a recession?..
Yes I think you brought up a very good point. Not sure how much the recession/soft landing will affect the high technology job market. The high tech job market is just picking up in many areas and companies are having tough time to get employees. Whatever the opponents of H1B might say, the fact is getting eligible candidates is tough in many areas. And that is why many big companies are advocating visa increases (they have vested interest in only asking for h1b increase and don�t care about EB numbers; that�s a different issue). To take advantage of that sentiment � this is the best time. We don�t know how political/economic situation in next year (2007) and 2008 being presidential election year, immigration can become a hot button issue and politicians will club our issues with illegals which can confuse everyone. Lame-duck session is our best chance yet to have any of our measures. Corporate world looking for more H1B numbers will work hard and try to put in their measures in some bill. We have to work hard to have our measure clubbed to them.
If SKILL bill is passed in total that would be our best case scenario but I think its really difficult (anti-immigration groups and their lobbying is much stronger than many of us think; just look at what happened in the last one year to several bills that are even slightly favorable to legal immigration).

Would you mind sharing some evidence in case you have some ?
I didn't see EB2 guys overcrowding that event. There were well meaning, sincere members from both EB2 as well EB3.

My vote goes for DC on 7/14. Many people like me might have already used their time off recently to get a medical exam and paperwork for I-485. I live in Baltimore area and simply cannot make it to DC on a weekday. If I lose my job I won't get a green card - as simple as that.
If there are others in Baltimore area who would like to join the action please don't hesitate to contact me. We could car pool and get together to make signs. I'll also try to gather some friends, although it might be tough on a short notice - almost everyone is on vacation.
I dont need to tell you how DC looks like on a weekend. None but visitors. Your boss must be really cruel to let you go for ever if you need to take half day off. Just joking :) Go ahead and create a poll with all possible options and then you can figure out what is the best option

TSC is moving like a snail. Last week we saw just couple of cases getting receipt or checks chased for Jun 26 or less and even this week TSC has not moved a day.

Is there an advantage in opening a bank account if you plan to return to the US? Please let me know. I might want to open one myslef if it's going to help in anyway.

It worked for someone I know. It worked for me. And now to make it work for all of us we all have to chant. Remember, just 2 weeks!

Do you have any numbers for advocacy effort participation in terms of EB2 vs EB3 ? You and some EB2 members on this forum seems to be suggesting that they are getting GCs faster because you they did some outstanding effort in terms of IV advocacy effort. Would you mind sharing some evidence in case you have some ?
I didn't see EB2 guys overcrowding that event. There were well meaning, sincere members from both EB2 as well EB3.
Please stop lecturing EB3 guys. If pappu or someone from leadership want to lecture us, it is fine. Not every jack and jill on this forum should lecture us.
ok, let me put the matter to rest before you take it out of context. My observation was based on the thread that we had for collecting the amount..I didn't see many EB3 folks contribute dollars....but now that 2 EB3 are vouching that enough EB3 folks contibuted, that's great. I just observed something and if it hurt you right down the spine, sorry. I filed PERM 3 months ago, I'm far off in this process. Just focus on advocay so that everyone gets their GCs. Good luck. I hate this EB2 vs EB3, this is a never ending debate. Just hope everyone gets their GC in time.
