    Today I spoke to a Representative who deals with immigration issue at Sen Mike Dewine's (R-OH) office. I spoke to him for 15 minutes to understand what he and his senator think about this CIR.

    Here is he and his senator feels about this bill. It is difficult for him to say that when CIR bill will be introduced in senate floor . It depend on Majority and Minority leaders to decide. Majority leader told to the media that he will introduce before the end of the may, he is mostly consistent, but there are several bills where he has committed a timeline and till today it is not on the floor.
    However he told that once CIR pass, legal immigration is already taken care of, but if it does not passes there are bills like SKIL which will be put before the floor. But CIR has to fail or pass before you see this SKILL bill on the floor.

    Great to hear you spoke to the senator and the feedback you got from him is very engouraging.

    My case was received by NSC on JUN 1st. They issued the recipt numbers on JUN 5th. I am still waiting on my wifes. They could clear on Monday.. Looks like NSC is also trying to speed up things. They are just one day slower than TSC in issuing recepts.

    I have to get the EMP LETTER latest by Friday June 29th from employer.
    For that i have to sign the agreement by June 28th Noon time.

    Today is June 26th and they are still working on agreement with their lawyers and would probably give me the final agreement tomorrow 27th noon time.

    Between 27th Noon and 28th Noon how can i consult a lawyer ??

    It all depends on how you want to lose the money.
    (a) Pay the employer for breaking the agreement
    (b) Do nothing and let employer send your case to collection agency. Ignore the collection agency and get black mark on your credit history (and lose money on higher mortgage/ auto loan rates, credit card interest, credit denial due to derogatory comments on credit report)
    (c) Do nothing and let employer take you to court. Then fight the case and
    (i) pay lawyer if you win
    (ii) pay lawyer and the employer if you lose

    At the end of the day, ask yourself how much it is worth to get a GC. If you think going through all this is not worth it, tell you employer to go take a walk and quit. You can start all over again with someone new.

    :) sure you are otherwise you wouldn't be living here.

    I am not againist H4 guys but i can't help but laugh when H4 guys complain that they were being treated bad by not allowing them to work.

    One has to understand that US allows ppl on a certain basis and H4 is nothing but to join your spouse (or something like that for kids).

    One can request them to make a provision for H4 ppl to work but blaming that they haven't done that simply by fogetting on what basis they entered US.... hmmm i don't know.

    Questioning their speed of process and other irregular rules... yes i am with you but blaming them for above ... i don't think that is fair.
    I wonder how many who come here on H4 know what complexities lay ahead in the G.C processing. unfortunately it is not easy to undo their marriage and go back.
    They need a fair deal too just like the way those in EB-3 are waiting for a proposal that addresses their issues more directly rather than trickle down. I guess u r one of them.
    I dont know how much u know about G.C before u came here. I am yet to understand it clearly.

    First I had to laugh. Then I had to cry.

    I took part in commencement this year at Rensselaer Polytechnic Institute,
    one of America's great science and engineering schools, so I had a front-row
    seat as the first grads to receive their diplomas came on stage, all of
    them Ph.D. students. One by one the announcer read their names and each was
    handed their doctorate - in biotechnology, computing, physics and
    engineering - by the school's president, Shirley Ann Jackson.

    The reason I had to laugh was because it seemed like every one of the newly
    minted Ph.D.'s at Rensselaer was foreign born. For a moment, as the foreign
    names kept coming - "Hong Lu, Xu Xie, Tao Yuan, Fu Tang" - I thought that
    the entire class of doctoral students in physics were going to be Chinese,
    until "Paul Shane Morrow" saved the day. It was such a caricature of what
    President Jackson herself calls "the quiet crisis" in high-end science
    education in this country that you could only laugh.

    Don't get me wrong. I'm proud that our country continues to build
    universities and a culture of learning that attract the world's best minds.
    My complaint - why I also wanted to cry - was that there wasn't someone from
    the Immigration and Naturalization Service standing next to President
    Jackson stapling green cards to the diplomas of each of these foreign-born
    Ph.D.'s. I want them all to stay, become Americans and do their research and
    innovation here. If we can't educate enough of our own kids to compete at
    this level, we'd better make sure we can import someone else's, otherwise we
    will not maintain our standard of living.

    It is pure idiocy that Congress will not open our borders - as wide as
    possible - to attract and keep the world's first-round intellectual draft
    choices in an age when everyone increasingly has the same innovation tools
    and the key differentiator is human talent. I'm serious. I think any foreign
    student who gets a Ph.D. in our country - in any subject - should be
    offered citizenship. I want them. The idea
    that we actually make it difficult for them to stay is crazy.

    Compete America, a coalition of technology companies, is pleading with
    Congress to boost both the number of H-1B visas available to companies
    that want to bring in skilled foreign workers and the number of employment-
    based green cards given to high-tech foreign workers who want to stay here.
    Give them all they want! Not only do our companies need them now, because we
    're not training enough engineers, but they will, over time, start many more
    companies and create many more good jobs than they would possibly displace.
    Silicon Valley is living proof of that - and where innovation happens
    matters. It's still where the best jobs will be located.

    Folks, we can't keep being stupid about these things. You can't have a world
    where foreign-born students dominate your science graduate schools,
    research labs, journal publications and can now more easily than ever go
    back to their home countries to start companies - without it eventually
    impacting our standard of living - especially when we're also slipping
    behind in high-speed Internet penetration per capita. America has fallen
    from fourth in the world in 2001 to 15th today.

    My hat is off to Andrew Rasiej and Micah Sifry, co-founders of the Personal
    Democracy Forum. They are trying to make this an issue in the presidential
    campaign by creating a movement to demand that candidates focus on our
    digital deficits and divides. (See: http://www.techpresident.com <http://www.techpresident.com>.) Mr. Rasiej, who unsuccessfully ran for public advocate of New York City in 2005 on a platform calling for low-cost wireless access everywhere, notes that "only half of America has broadband access to the Internet." We need to go from "No Child Left Behind," he says, to "Every Child
    Connected."

    Here's the sad truth: 9/11, and the failing Iraq war, have sucked up almost
    all the oxygen in this country - oxygen needed to discuss seriously
    education, health care, climate change and competitiveness, notes Garrett
    Graff, an editor at Washingtonian Magazine and author of the upcoming book "
    The First Campaign," which deals with this theme. So right now, it's mostly
    governors talking about these issues, noted Mr. Graff, but there is only so
    much they can do without Washington being focused and leading.

    Which is why we've got to bring our occupation of Iraq to an end in the
    quickest, least bad way possible - otherwise we are going to lose Iraq and
    America. It's coming down to that choice.

    Hi,

    If the Dems win control of the Senate, I expect no major changes for us. The amnesty bills are already passed easily in the Senate as is anyway. That doesn't change anything for us there.

    In the House, this will be a close race. Even if Dems barely win in the House, what is less likely, then they may well find themselves struggling again to get major votes for the amnesty bills. Remember that the amnesty bills got rejected in the House by large margin - and - enforcement only bills got approved there widely. Our stand alone SKULL bill - not sure whether that will be considered by Democrats. Democrats will probably address the Dream Act before they take over the SKULL bill. Let them pass Dream Act, and then we, the Employment Base applicants will be in a real dream for a long time.

    It won't be easy, folks.

    At least with DEMS there is close to surety of passing one Immigration Bill even if it is CIR.... With REPs, we will never see any bill the light of day... Not sure which world you live in but check out numbersusa site and you will see how they are trying to decrease the immigration - legal or illegal alike.... So while Skill will go through Senate, it will be again blocked in house like it was in Dec2005........ So bottomline is that I would rather have some bill passed and have a hope in sight than no bill and never know if one will ever get GC

    I will definitely call senator's office and talk and even take appointment. For me the senators nearest office is 150 miles drive one way. But I will do that.
    The House representitive's office is less than half a mile's drive. But he is a member of Toncredo's immigration caucus and it is plain useless to talk to them.

    The highlighted message is the key to the next step.
    At most times you are likely to get such automated responses and message would be ignored unless backed up by lobbying effort. Each campaign is carefully crafted and the strategy is based on our ongoing lobbying efforts.This is why we ask for a focused message and followup instead of sending junk emails (from online petitions) and thinking our work is done after hitting the submit button. It is a waste of time and energy and misleads the community in what they should be doing to get attention to their issues. Sending email is just one tiny step towards the advocacy work. Next step is to call the office and follow up about the email. Tell them you are not satisfied with such a response on an important issue. Tell them that you want to talk to someone about your letter and also wants to meet them in their office as you are a constituent and part of a national organization.     I understand we want to stand alone with our issues and that may be favourable to us from an anti-immi stance taken by many in Govt and otherwise. I am not sure though if by alienating EB retrogression issue with H1B increase we will be able to get anything done.

    Our main supporters are teh corporations who hire us and want us to be perm. There bigger concern right now is getting more people who can hired on H1B. Unless we threaten mass exodus, I do not think we stand a chance if we try to run alone with only EB retrogression issue.

    People (Senators aginst CIR or SKILL and even NUmbers USA) may say that OK we are not against you folks, but the point is will those same people do something about our predicament if this was the only thing on the table, I dont think so.

    nousername,If your would-be employer had sponsored the visa,it got selected and then he has to not hire you on Oct1st because of his business not doing so well, what would you do?

    Ideally your employer should rescind your offer and buy you a ticket back home.
    But in the IT industry, that is the reason most people still work with desi employer, even thouh they know that they will be taken advantage of.

    Is it illegal? Yes. But there is a risk for the people involved.

    Also, when someone tries to land H1 for the first time, it is really tough to find an employer who can apply 6 months in advance.Most american companies don't even go through the hassle unless they are hiring for non-IT positions. Then you have companies like Infosys who apply in bunches and keep them ready for the business they are expecting in future. Try and argue with them that they shouldn't do that as many people who have jobs lined up right now will not get H1s.

    In my opinion most people who are on H1 n IT with american companies, either got in there via OPT- H1 or H1 transfer.

    You gotta do what you gotta do. If you keep thinking about all deserving people,you would never take a step forward. At everypoint in life you will have certain options and every option woul cause some or other discomfort. Unless you are involved in clearcut criminal activity, everything else is fair, in my opinion.

    After I answered Neha's question, which I know is the correct answer, I asked her a simple question i.e. is it ethical to apply for H1 visa when a person does not have a job offer, especially when the entire legal immigrant community knows that for last few years due to the visa cap it is very hard to obtain a new H1 even if you have a valid job offer.

    I totally agree with you that no one on the face of this earth is a pure saint but ours (legal immigrants) is a small hardworking community, which most often understand each others pains, and that's the reason this forum exist.

    Now, I ask you in the most humble way, what would you have done if your would-be employer had sponsored the visa but due to the lottery your application was never even selected for processing. To top that you learn from all over the world that companies like Wipro, Satyam and desi body shops applied for H1's, which they probably won't even use. Don't get me wrong.. I am a proud Indian and proud what these companies have archived..

    Guys even H1B increases are not that bad. A lot of our spouses could get jobs on h1b if it was open just now. Ultimately isint that what we want? Both husband and wife working?

    I know that it could have a possible effect on the EB but I think a LOT of our spouses could work if the H1B quota was available. I know atleast 2-3 such friends whose wives can easily get jobs if the H1B was open.

    Thanks sledge for your support.. That's exactly what I meant. One should at least have a job before applying for H1. I am in totally favor of H4 visa holders to be able to work. There are so many highly educated and talented people out there who are stuck at home or school because of H4 work permit law.

    I wish good luck to all H4 visa holders and other people who are stuck in this immigration system.

    7% quota based on national origin is based on law but it is clearly a biased and outdated law. It is beyond my comprehension why should we scared of initiating a litigation against the US government when it is clearly involved in blatant discrimination. The HSMP rules were challenged successfully by Indian high skilled workers in UK, why can't we do the same over here? I pledge to donate USD 200 for a lawsuit if such an action is initiated.
