Guys
I got all my receipts today (Mine and my wife receipts)...My case is
Received by J.Barrett at 10:25 AM at NSC, Case transferred to TSC on 08/05/2007 (Based on LUD). Notice Date is 09/04/2007.
My I-140 is from TSC. I know what I went through this whole 70 day process, but as the saying goes 'There is light at the end of the tunnel'.
Thanks IV...I owed that I pay some money towards the rally and will do that now.

Hello All..
Can anyone throw some light on why some cases have not been receipted so far and are pending for any action..No rejections, no receipts no cheques ..nothing..
I see guys already starting to discuss EAD and opening companise etc..
We are still waiting for the ACK fron USICS...
My case was received at NSC on 18Th July by R cook, whose name I havent seen in this frum...and no info so far..Called USICS and talked to 2nd level clerk but no receipted so far.. so they have no info..

Even if we have five people agree to file this class action lets do it .....
Once we have this law suit filled I'm sure will have the visiblity and whole band wagon will behind us.
1, Let choose an attorney who understands our pain wants to fight for our cause. if its Rajiv Khanna so be it.
2, Whatever the inital attorney consultion let split the consultation fee between five of us.
3, Once we have a stream lined class action in place will gather more people.

I absolutely agree what you said this will atleast help us to predict where we are with the processing ..If this whole thing is going to take 22 years tell us now..so we won't F****** throw away our life waiting for it.

1) breakdown of processing dates in a manner that co relates to visa bulletin.
i.e.: tell us how many petitions by per country are pending/processed and processing dates by country and category. Atleast USCIS is answerable to visa bulletin.
2) Visa usage by category reporting each month
(How many petitions were approved are pending by visa category and by country) (here I mean just I140 and I485). Adjust the numbers if there are denials.

the point here is not how long its gonna take. Its sure that they r gonna work if not immediately may be in 3-4 months. and once they see all the proofs(i do have proofs) whole company will be audited rock bottom, all the gc filing will be verified and single loophole is just enough to cause irriparable damage to the company. not only the reputation but i heard they will have a high penalty of 100's of thousands dollars. I have contacted one of the top lawfirms.for the matter of $4000 if the company chooses to do it, its their foolishness. also if they genuinely wanted to enforce non compete they wouldn't have used it as a threat agiainst payments they owe me.
Its not that I haven't made any efforts to reconcile with my ex-employer. I have tried and still trying to get them to have a civil conversation and settle this. But the more I try, i beleive, they r thinking the more scared i am and are being arrogant by not replying to any of my emails or phone calls. My reconciling efforts are giving them wrong hints i beleive. I am definetly stressed about this,thats true, but i am not scared because of all the info i gathered, I know even they do file a suit, I will be on the winning side. though i have option to go directly to DOL or USCIS and can show all the proofs i have regarding the deductions they have made, i haven't made till today just because of the kind of relationship we had earlier and also concerned about other h1bs who r with the company right now. I too think the same, if the company had to sue you for violating non-compete, they could have done it anytime, why are they threatening you when you ask for your salary. Either they do not have a non-compete agreement that they say you have signed (since you are not sure about it) or the non-compete has become invalid over a period of time or it does not hold water.

Before accepting an Employement with company X, if there would have been an agreement stating they will sponsor my green card (atleast the paperwork), that would have helped me.. hard luck..

I have a electronic mail from them with the 140 receipt Notice (as PDF)
from USCIS.. I took the LIN number from there and Queries USCIS - they says USCIS received my App on May 15th and under processing....
I took a Print out of that 140 receipt Notice and will attach with 485 Application... My approval will not come before Jan-Feb 2008.
But don't you need copy of 140 also?
Canda is not the only option.You can tell them that u r resigning.In that case u might not win but atleast he will loose everything.So might be he will ready.

If you think it is that ridiculuous, then you should tell the core members that. They did ask us to call him on the last day of LD. There is nothing wrong in writing to him. In fact, you are making a comparison that is not correct.
Actually, it was an exceptional situation. As you are well aware of, we had to get an unanimous consent if the skil bill were to pass in the LD, so, we needed to have Session's approval. To deflect the situation, he just said that his office hadnt received any positive comments.. When we ended up jamming his phones and gave all the positive comments, what came out of that, nuthing.. he did not budge from his stance.. It was just a ploy and even if the entire US of A had called him, he would not have changed his stance.. He had to score brownie points from his supporters. He knows that the Skil bill will be passed next year, and may be some form of CIR even.. He can then blame it on the democrats and stand for re-election in 2009 with complete support from his supporters..
Its all a gimmick for votes. This is politics, same thing in every country, just more sophisticated here...
